State-by-state at a glance

The rules differ meaningfully depending on where your property is:

Delhi (Delhi Rent Act, 1995): If you do not have a written rent agreement, rent increases are limited to 10% every three years. If you have an agreement, the agreed escalation applies.

Maharashtra (Rent Control Act, 1999): For old buildings, increases are pegged to a formula. For newer properties, standard escalation clauses in the agreement are honoured.

Give written notice 30-60 days before the increase, and get the tenant to acknowledge it in writing.

Put the escalation clause in the original agreement — a mid-term increase without a clause is the most common source of disputes.
