The Great Maintenance Tug-of-War: Why Deductions Cause Most Rental Lawsuits
Nothing sours a landlord-tenant relationship faster than a clogged drainage pipe or a peeling wall. When an Indian tenant vacates, the inevitable confrontation occurs: *The landlord wants to deduct ₹25,000 from the security deposit for fresh painting and plumbing; the tenant argues it is normal wear and tear.* Understanding Indian rental law—specifically the Second Schedule of the Model Tenancy Act (MTA)—provides clear statutory boundaries for who pays for what, eliminating disputes before they begin.

Structural vs Wear-and-Tear: The Fundamental Legal Division
Under standard Indian lease practices and the Model Tenancy Act, repair responsibilities are divided into two distinct categories:
Who Pays for Painting on Move-Out? (The Golden Rule)
Painting deductions are the #1 source of deposit friction in Bangalore, Mumbai, and Gurgaon. Here is the legal standard: - Normal Wear & Tear (Landlord Absorbs): Faded wall paint due to sunlight, subtle furniture shadows, or microscopic hairline settlement cracks cannot be deducted from a tenant's deposit. Indian courts have consistently ruled that landlords cannot charge tenants to restore an old apartment to brand-new condition. - Tenant Damage (Tenant Reimburses): Crayons, nail holes, deep grease stains behind kitchen stoves, broken plaster from wall-mounted heavy TVs, or unapproved dark wall painting are damages attributable to the tenant. - The "One-Month Rent" Painting Clause Myth: Many Bangalore agreements state "one month rent will be deducted for painting". Under the Model Tenancy Act, such automatic arbitrary deductions are unconscionable unless the property was demonstrably handed over in pristine painted condition and damaged beyond normal use.
The "₹1,000 Rule": How Smart Landlords Prevent Petty Friction
Seasoned property managers include a Minor Repair Threshold clause in their agreements. Under this clause, any individual repair costing under ₹1,000 (such as replacing a bathroom tap washer or bulb holder) is resolved directly by the tenant without calling the owner. Any repair exceeding ₹1,000 requires landlord written approval and is funded by the landlord.

COVENANT FOR REPAIRS AND MAINTENANCE OF PREMISES
1. Day-to-Day Repairs: The Tenant shall be responsible for minor routine maintenance and repairs costing less than ₹[1,000] per incident, including replacement of tap washers, electrical fuses, light fixtures, and drain cleaning.
2. Structural & Major Repairs: The Landlord shall be responsible for all structural repairs, including external dampness, ceiling seepage, failure of concealed electrical wiring, and major plumbing breakdowns not caused by tenant negligence.
3. Move-Out Wall Painting: The premises has been handed over newly painted. The Tenant agrees to maintain walls in reasonable condition. At the time of vacating, fair wear and tear shall be accepted. Deductions shall only apply for deep stains, unauthorized drilling, or substantial wall defacement, backed by itemized contractor receipts.
4. Emergency Repairs: If the Landlord fails to attend to critical structural repairs within 72 hours of written notification, the Tenant may execute the repair and deduct the substantiated expense from subsequent rent.
